Over the past year, Clubs SA has received a notable increase in the number of members advising that they were having issues with their leases, finding that costs have become unsustainable and assumptions they made in relation to the lease were incorrect.  It is vitally important that before a club enters into a lease with council, or other entity, they properly look over and understand the terms of the lease.   Proper due diligence must be undertaken

Written employment contracts are vitally important in setting out the terms and conditions that relate to someone’s employment.   It is possible for a verbal contract to exist but the terms of these will be very unclear and greatly increase the chances of disputes later arising.   Written employment contracts also help ensure certain record keeping obligations are met and certain agreements need to be in writing

Clubs SA members are advised that a case before the Federal Circuit Court has clarified when someone’s final pay must be provided after someone has officially resigned or had their employment terminated.  Previously the understanding for most employees and industries was that this had to be made within 7 days of their final day. The Registered and Licensed Clubs Award 2020 (Clubs Award) in clause 20.6 also states that any entitlements due under it
